OBJECTIVE This is the official web site of Sabah Law Courts set up with the
aim of promoting transparency and of informing the advocates and the
public how the courts function and how cases are being dealt with.
This site covers the courts in Kota Kinabalu, Sandakan, Tawau and Labuan,
including the courts in the various districts. You can read the full text

EVIDENCE DE BENE ESSE In view of the long waiting time for a civil case
to come on for trial the advocates or the parties are well advised to
consider applying to the court to have the evidence of, for example, old
or seriously ill witnesses, taken first before the trial, that is de
bene esse.

appearing in court in contentious matters are expected to refer to the
most recent relevant decisions of the Federal Court or of the Court of
Appeal and these can

MASTER SCHEDULES The master schedules of

HIGH COURT I - DIVORCE PETITION The judge was on May 16 referred
to Sivanesan v Shymala [1986] 1MLJ 400.
PROBATE & ADMINISTRATION High Court I has also been
rejecting applications to wind up the estate of deceased persons because
s 101 and s 102 of the Probate and Administration Ordinance were not
complied with. For ease of reference, the sections are reproduced and

HIGH COURT 1 - RESCHEDULING OF TRIAL
CASES There is rescheduling of
the the trial cases of High Court I. This is necessary to take into
account the leave Ian Chin J will be taking from September 8 to November
7 in order to avoid the accumulated leave days being forfeited. It is
also to accommodate more criminal trial cases being registered and
criminal cases which the Court of Appeal had reversed Ian Chin J
decision but which grounds of decision of the Court of Appeal are still
being awaited. Check the Master Schedules for 2008, 2009, 2010 and 2011
to see the new date of trial.
